The Supreme court forbade GAI officers to fine employees of Office of Public Prosecutor

The Supreme court of the Russian Federation forbade inspectors of traffic police to make reports on infringements of traffic regulations concerning employees of Office of Public Prosecutor. The office document of the Municipal Department of Internal Affairs of the Novosibirsk region in which GAI officers were authorised to fine public prosecutors workers for infringements of traffic regulations became an occasion to such judgement as informs RIA Novosti news agency.
however the Office of Public Prosecutor considered that this document breaks norms of the law “About Office of Public Prosecutor of the Russian Federation“ and positions of KoAP of the Russian Federation. As they say in the message published on a site of the State Office of Public Prosecutor of the Russian Federation, “according to requirements of the federal legislation any check on the facts of the infringements made by the public prosecutors worker or the inspector, is an exclusive prerogative of bodies of Office of Public Prosecutor“. Therefore the Office of Public Prosecutor addressed at first in the Central district court of Novosibirsk, and then in regional court, however both instances refused to it satisfaction of the claim.
the Disputable situation was resolved by the first deputy of the Public prosecutor of Russia Alexander Buksman who addressed with representation in the Supreme court of the Russian Federation. The court agreed with arguments of Office of Public Prosecutor and recognised corresponding point of the office document of the Municipal Department of Internal Affairs of the Novosibirsk region illegal.
