The order of the Ministry of Justice of the Russian Federation from March, 31st, 2009 N 92 Moscow About accreditation legal and physical persons as the independent experts authorised on carrying out of examination of projects of standard legal certificates and other documents on korruptsiogennost

According to Rules of carrying out of examination of projects of standard legal certificates and other documents with a view of revealing in them of the positions promoting creation of conditions for display of corruption, confirmed by the governmental order of the Russian Federation from March, 5th, 2009 N 195 (Meeting of the legislation of the Russian Federation, 2009, N 10, item 1240), I order:

1. To confirm applied Position about accreditation legal and physical persons as the independent experts authorised on carrying out of examination of projects of standard legal certificates and other documents on korruptsiogennost.

2. To department of the constitutional legislation and the legislation on safety (E.A.Nehaj) to provide carrying out of accreditation legal and physical persons as the independent experts authorised on carrying out of examination of projects of standard legal certificates and other documents on korruptsiogennost.

3. To department of management, the organisation and control (N. B.Vishnjakova) to provide placing on an official site of Ministry of Justice of Russia in a network the Internet of the information on accreditation legal and physical persons as the independent experts authorised on carrying out of examination of projects of standard legal certificates and other documents on korruptsiogennost, and also about its cancellation.

4. To department of an administrative office (S.A.Rumjantsev) to provide manufacturing of certificates on accreditation legal and physical persons as the independent experts authorised on carrying out of examination on korruptsiogennost.

5. To heads of territorial bodies of Ministry of Justice of Russia to organise delivery of certificates on accreditation legal and physical persons as the independent experts authorised on carrying out of examination on korruptsiogennost.

Position about accreditation legal and physical persons as the independent experts authorised on carrying out of examination of projects of standard legal certificates and other documents on korruptsiogennost

I. General provisions

1. Position about accreditation legal and physical persons as the independent experts authorised on carrying out of examination of projects of standard legal certificates and other documents on korruptsiogennost (further - Position), defines an order of reception of accreditation, refusal in accreditation and its cancellation.

II. The basic requirements for accreditation reception

Legal or the physical person who has expressed desire to receive accreditation on carrying out of examination of projects of standard legal certificates and other documents on korruptsiogennost (further - accreditation) and presented written statement, and also the information necessary for reception of accreditation, in Ministry of Justice of Russia, should meet the obligatory requirements provided by point 6 of Rules of carrying out of examination of projects of standard legal certificates and other documents with a view of revealing in them of positions, conditions promoting creation for display of the corruption, confirmed by the governmental order of the Russian Federation from March, 5th, 2009 N 195 (further - Rules).

III. An order of reception of accreditation

3. For reception of accreditation the legal body represents to Ministry of Justice of Russia personally or by mail:

1) the statement for the accreditation, made in any form, signed by the head of the organisation with putting down of date and assured by an organisation impress of a seal, with obligatory instructions of the mailing address on which the answer should be directed, and e-mail addresses, in a case if expert judgements will go in the form of the electronic message (the document);

2) the certified copy of the certificate on the state registration of the legal person;

3) signed by the head of the organisation the list of employees of the organisation which are meeting the requirements to accreditation of the physical person;

4) certified copies of documents of the state sample about the higher vocational training of the specified employees of the organisation;

5) certified copies of work record cards of the specified employees of the organisation;

6) certified copies of the documents certifying the persons of specified employees of the organisation.

4. For reception of accreditation the physical person represents to Ministry of Justice of Russia personally or by mail:

1) the statement for the accreditation, made in any form, with obligatory instructions of a surname, a name, a patronymic (the last - at presence), the mailing address on which the answer should be directed, and the e-mail address, in a case if expert judgements will go in the form of the electronic message (the document), and also with obligatory putting down of the signature and date;

2) a copy of the document of the state sample about the higher professional formation;

3) a work record card copy;

4) a copy of the document proving the identity.

5. The decision on accreditation or on refusal in accreditation is accepted by Ministry of Justice of Russia within 20 working days from the date of receipt in central office of Ministry of Justice of Russia of the documents specified in points 3 and 4 Positions, after check of completeness and correctness of their registration.

6. At acceptance of the positive decision the order of Ministry of Justice of Russia about accreditation of the legal or physical person as the independent expert signed by the deputy minister of justice of the Russian Federation according to distribution of duties is published.

7. At refusal in accreditations the Ministry of Justice of Russia sends to the address of the applicant the letter signed by the deputy minister of justice of the Russian Federation according to distribution of duties with instructions of the reasons which have formed the basis for acceptance of such decision.

8. The bases for refusal in accreditation are:

1) discrepancy of the physical or legal person to the requirements provided by point 6 of Rules;

2) nepredstavlenie or inadequate official registration of papers.

9. The official documents certifying accreditation, are the certificate on accreditation of the legal person as the independent expert authorised on carrying out of examination on korruptsiogennost, and the certificate on accreditation of the physical person as the independent expert authorised on carrying out of examination on korruptsiogennost (further - certificates on accreditation), the Ministries of Justice of the Russian Federation given out on the basis of the order (appendix N 1 and 2).

Certificates on accreditation subscribe the deputy minister of justice of the Russian Federation according to distribution of duties and stand out for five years. The payment for accreditation, including for delivery of certificates, is not raised.

Within 10 working days from the date of the edition of the order of Ministry of Justice of Russia about accreditation of the legal or physical person as the independent expert the Ministry of Justice of Russia makes out the certificate on accreditation and directs it to territorial body of Ministry of Justice of Russia in the location of the applicant for delivery to the applicant or its authorised representative under a list with representation of the document proving the identity of the citizen.

the Territorial body of Ministry of Justice of Russia directs acknowledgement on delivery of the certificate on accreditation to central office of Ministry of Justice of Russia.

About delivery of certificates on accreditation the corresponding log entry of Ministry of Justice of Russia under the account of delivery of certificates on accreditation is made.

10. The information on accreditation legal and physical persons takes place on an official site of Ministry of Justice of Russia in a network the Internet.

IV. Order of cancellation of accreditation

11. Accreditation is cancelled by Ministry of Justice of Russia in cases:

1) voluntary refusal accredited legal and physical persons from accreditation;

2) neprovedenija examinations on korruptsiogennost more than two years.

12. At decision-making on accreditation cancellation the order of Ministry of Justice of Russia signed by the deputy minister of justice of the Russian Federation according to distribution of duties is published and the log entry of Ministry of Justice of Russia under the account of delivery of certificates on accreditation becomes.

13. Within two working days after the edition the Ministry of Justice of Russia of the order about cancellation of accreditation to the legal or physical person sends the corresponding letter.

14. The information on accreditation cancellation takes place on an official site of Ministry of Justice of Russia in a network the Internet.
